1. California privacy rights

This notice is for people who live in California. California residents may have certain rights under applicable California privacy laws regarding the personal information businesses collect about them.

This page explains, in plain terms, what personal information SocialCue collects, where it comes from, how it is used, who it is shared with, and how a California resident can make a privacy request. It is a supplement to our Privacy Policy — it does not replace it, and the two should be read together.

2. Scope

This notice covers personal information SocialCue collects through the SocialCue mobile app and the SocialCue website.

It does not cover information you give directly to anyone else — for example a venue you visit, another member you choose to connect with, or a social media platform whose handle you choose to share. Once you share a social handle with a member you have connected with, what that person does with it is outside SocialCue’s control.

3. Categories of personal information we collect

Depending on how you use SocialCue, we may collect the following categories of personal information:

  • Identifiers and account information. Your account identifier, display name, and the email address you sign in with.
  • Age and gender. Your gender (woman or man), your date of birth (day, month and year) and your birth month and year, and a record that our 18+ age check was performed (when, the method used, and the minimum age applied).
  • Consent and agreement records. If you agree to receive a verification text, when you agreed, the wording you were shown and where you agreed; and, before you buy credits, which version of our Terms of Service you agreed to and when.
  • Fingerprints. One-way cryptographic fingerprints of your email address and, if verified, your phone number, used to prevent repeated free-trial signups and duplicate referral rewards, to limit role changes, and to limit phone-verification attempts. They cannot be reversed.
  • Profile information. Your photos, biography, interests, age bracket, relationship status, home city and state. Your home city and state are a city-and-state preference you provide — not coordinates, and not the precise geolocation described below.
  • Community (optional; sensitive personal information). If you choose to provide it, your community — Heterosexual or LGBTQIA+ — and your separate choices about whether it is used for Venue filtering and whether an LGBTQIA+ badge is shown on your profile. Prefer not to say stores nothing.
  • Identity details (optional; sensitive personal information). If your community is LGBTQIA+ and you choose to provide them, your gender identity and up to three sexual orientations, selected from fixed options, and your separate choices about whether each is shown on your profile. Prefer not to say stores nothing. We do not collect intersex status or other information about sex characteristics.
  • Contact information. A phone number, and any social media handles you choose to add for sharing after you connect with someone.
  • Authentication information. Information used to sign you in, including sign-in through Google if you choose it, and phone verification information where you complete it.
  • Device and notification information. Device identifiers used to deliver push notifications to your device, including a push token and app-installation identifier that Google’s push service creates when the Android app is first opened; the IP address and browser or app details of your sign-in sessions and of requests to our service; and a random identifier that our map provider’s software stores on your device (see section 6).
  • Location information, including precise geolocation. Your device’s location while you are using the app and, if you turn on arrival reminders and allow it, in the background. When we send an arrival reminder we keep a record of the venue and time. See section 8 below.
  • Presence and venue activity. Which mapped venue you are at, and when, while presence is active. At a hotel, the designated public area you choose and when that choice starts and ends.
  • Event participation. Events you RSVP to and attend.
  • SocialCue Connect information. Whether you have joined SocialCue Connect and the role you have chosen.
  • Invitations and connections. Invitations you send or receive, and the connections that result, including for hotel Connections the designated public area an Invitation was sent from and each member’s self-reported Meet First confirmation.
  • Community content. Comments and poll responses in SocialCue channels.
  • Trust and safety information. Reports you submit or that are submitted about you, blocks, and related moderation records.
  • Referral information. Referral codes and whether an invited person activated.
  • Wallet, credits, and membership information. Your credit balance, transaction history, and membership status.
  • Transaction information. Credit purchases made through Google Play (and any store subscription record from an earlier version of the app; no subscription is sold today) — for a credit purchase, the product, the number of credits and price, the store’s purchase token and order number, when it was made and credited, and whether it was later refunded or reversed. Google Play processes payments; SocialCue does not receive or store your payment card details. Google Play also keeps its own records of these transactions under its own terms and privacy policy, which SocialCue does not control.
  • Usage and acquisition information. Internal records of how the app is used and how you first arrived, used to operate and improve the service.
  • Cookies and similar technologies. A small number of cookies used to keep you signed in and to support referrals and security. SocialCue does not use advertising cookies, advertising SDKs, tracking pixels, ad networks, or third-party analytics products.

4. Sources of personal information

We collect personal information from these sources:

  • Directly from you — when you create an account, build your profile, add photos, verify a phone number, RSVP to an event, post in a channel, or send an invitation. Your community, if any, comes only from your own choice; we never infer it from other information. The same is true of your Identity details.
  • Automatically from your device — location while you use the app (and, if you turn on arrival reminders and allow it, in the background), device identifiers for push notifications, technical details such as IP address and browser or app details, and cookies.
  • From other members — for example when someone invites you, connects with you, or submits a report about your conduct.
  • From service providers — for example confirmation from Google Play that a purchase is valid, or confirmation from a sign-in provider that you signed in successfully.

5. How SocialCue uses personal information

We use personal information to:

  • create and maintain your account and profile;
  • show you nearby mapped venues, and show your presence at a venue to other members according to your settings;
  • operate invitations and connections, and share social handles only when you separately opt in;
  • if you choose a community, include you in the matching community view of a venue’s visible members list and show an LGBTQIA+ profile badge — each only if you have switched that use on;
  • if you add Identity details, show on your profile each detail you have switched on;
  • show and operate events, RSVPs, and channels;
  • send notifications you have enabled;
  • use your date of birth to send you a Happy Birthday message on your birthday and, if SocialCue turns on birthday promotions, use your birth month to send you up to three reminders about SocialCue birth month events, on dates SocialCue chooses (two in the months before your birth month and one during it) — only to you, never showing your date of birth or age;
  • operate the wallet, credits, membership, and subscription features;
  • operate referrals;
  • keep SocialCue safe — reviewing reports, moderating photos and content, enforcing our guidelines, and preventing fraud and abuse;
  • understand how the service is used so we can improve it; and
  • meet legal and regulatory obligations.

We do not use personal information for behavioral advertising or advertising profiling. Your community is not used to understand or analyze how the service is used, to match members or suggest compatibility, or to decide your role, pricing, membership, credits, referrals, or any other entitlement. Your Identity details are likewise never used for venue lists or community views, matching, recommendations, your role, eligibility, pricing, or any entitlement.

6. Disclosure to service providers and other parties

SocialCue discloses personal information to service providers who perform functions on our behalf and are permitted to use the information only to provide those services. These fall into the following categories:

  • hosting, database, storage, and authentication providers;
  • email and text-message delivery providers;
  • push notification delivery providers;
  • our map provider;
  • Google Play, which processes credit purchases; and
  • security and content delivery providers that help keep the service available and protected.

Our map provider. Maps are provided by Mapbox. When a map is shown, your device sends Mapbox technical information about that map session — a random identifier that Mapbox’s software stores on your device, your IP address, browser details, and map-load events — but not your name, email address, phone number, or GPS location. To center the map, our server sends Mapbox the name of the city and state being shown, without your name or any identifier of you or your device. Mapbox handles this information under its own privacy policy and may use it for its own purposes, such as operating, securing, and improving its services, so it is not limited to acting on our behalf. The Privacy Policy describes this in full.

Information may also be disclosed to other members as part of how the product works — for example, your visible profile at a venue, a channel comment you post, or a social handle you opt to share after connecting. If you turn on the LGBTQIA+ profile badge, members who can see your profile see it. If you turn on Venue filtering, members who use the matching community view may be able to tell your community from where you appear. If you turn on the display of a gender identity or sexual orientation, members who can open your full profile see that detail. What is visible to whom is described in the Privacy Policy.

We may also disclose information where required by law, to respond to lawful requests, to protect the rights and safety of members or the public, or in connection with a business transfer.

7. Sensitive personal information

Some information SocialCue processes may be treated as sensitive personal information under California law. The clearest example is precise geolocation, described in the next section.

Community. If you choose to tell us your community (Heterosexual or LGBTQIA+), that information can reveal sexual orientation or gender identity and is treated as sensitive personal information. It is optional, comes only from your own choice, and is used only to include you in a matching community view of a venue’s visible members list and to show an LGBTQIA+ profile badge — each only if you have switched that use on.

Identity details. If your community is LGBTQIA+ and you choose to add them, your gender identity and sexual orientations are sensitive personal information. They are optional, come only from your own choice, and are used only to show on your profile the details you have switched on.

Where SocialCue processes information of this kind, it is to operate the features you are using and to keep the service safe — not for advertising, not to build advertising profiles, and not for purposes unrelated to providing SocialCue to you.

California residents may have rights concerning sensitive personal information where applicable law provides them. If you have a question or request about this, contact us using the details in section 22.

8. Precise geolocation

SocialCue collects precise location information from your device. This is central to how the product works: SocialCue shows which nearby mapped venues have people present, and determines whether you are inside a venue we have mapped.

Location information is used to:

  • show you nearby venues and activity;
  • determine whether you are inside a mapped venue’s boundary;
  • make you visible to other members at that same venue, according to your settings.

Location is collected while you are using the app. One exception applies: if arrival reminders are enabled for your account and you grant Android background-location permission, the app may also read your location while it is not open, only to determine whether you have arrived at a participating venue, to send you a reminder and, if SocialCue turns on Arrival Boost, for the use described next. An arrival reminder does not make you present at a venue or visible to other members. If SocialCue turns on Arrival Boost, an arrival confirmed this way may also add, for a few minutes and without identifying you, to that venue’s overall activity level on the Map. The Map never shows who arrived, individual arrivals, exact locations or headcounts, and venues we classify as hotels or other properties are never included. Background location is not used for any other feature. You can revoke that permission at any time in your Android settings, and nothing else in the app is affected.

You control location access through your device’s operating system settings and can withdraw it at any time. Location-dependent features will not work without it. You can also use Ghost Mode in the app to stop being visible to other members while continuing to use SocialCue.

Your home city and state are not precise geolocation. You set them in your profile, and they are used to choose which city’s venues and events we show you; your home city and state are also used to decide which channel posts and News you receive and which of our staff review reports about you. They are not read from your device and are not used to determine whether you are present at a venue. SocialCue does not currently offer a temporary travel location.

9. Sale and sharing of personal information

SocialCue does not sell personal information and does not share personal information for cross-context behavioral advertising.

We do not use advertising networks, advertising SDKs, tracking pixels, or third-party analytics products, and we do not disclose personal information to data brokers. Because there is no such sale or sharing, SocialCue does not offer a “Do Not Sell or Share My Personal Information” option — there is nothing of that kind to opt out of. If this ever changes, we will update this notice and provide the mechanism the law requires before the change takes effect.

10. Right to know and access

California residents may have the right to request that we disclose the categories and specific pieces of personal information we have collected about them, the categories of sources, the purposes for collecting it, and the categories of third parties to whom it is disclosed.

Much of your information is visible to you directly in the app, in your profile and account settings. For anything beyond that, you can make a request using section 15.

11. Right to delete

California residents may have the right to request deletion of personal information we have collected from them.

You can delete your account yourself from within the app, or in a web browser at app.socialcue.co/delete-account, except while your account is suspended. Deleting your account deletes or erases your profile and personal details and stops you appearing to other members.

Some records are retained after deletion where the law permits or requires it — for example records needed for security and fraud prevention, to resolve disputes, to enforce our agreements, to keep trust-and-safety and moderation records, and to keep records of purchases, credits, refunds, memberships, and subscriptions (to administer purchases and credits, verify purchases, handle refunds, reversals, chargebacks, and disputes, prevent fraud and a purchase being credited twice, keep accounting and tax records, and establish, exercise, or defend legal claims). We also keep a minimal record that the 18+ age check and any text-message consent took place, with your date of birth and birth month and year removed and the mobile number replaced by a one-way cryptographic fingerprint. Some information also remains because it is part of another member’s record, such as a connection you both took part in. The retained account record is not anonymous: it keeps an internal account identifier that links these records. Our messaging providers also keep copies under their own retention periods, as described in our Privacy Policy. In the limited cases described in Section 9 of our Privacy Policy (legal and safety exceptions), we may also keep information that would otherwise be deleted, and may be unable to complete a deletion request until that exception no longer applies.

12. Right to correct

California residents may have the right to request that we correct inaccurate personal information about them.

You can edit your profile information — including your display name, biography, interests, photos, location details, and your optional community choice and Identity details — directly in the app at any time. If something you cannot edit yourself is inaccurate, contact us using section 15.

13. Rights concerning sale or sharing

California residents may have the right to opt out of the sale of their personal information and of sharing for cross-context behavioral advertising.

As explained in section 9, SocialCue does not sell personal information and does not share it for cross-context behavioral advertising, so there is nothing to opt out of. We have not offered a control for this because offering one would suggest a practice that does not exist.

14. Rights concerning sensitive personal information

California residents may have the right to limit the use and disclosure of sensitive personal information where a business uses it for purposes beyond those permitted by law.

SocialCue uses information of this kind — principally precise geolocation, and your community if you choose to provide it — to provide the features you are using and to keep the service safe. We do not use it for advertising or profiling. You control your community directly in your profile: you can turn off its use for Venue filtering, turn off the profile badge, or choose Prefer not to say, which deletes it. You control your Identity details the same way: turn off the display of either detail, or remove them, which deletes them; changing your community away from LGBTQIA+ also deletes them. If you have a question or a request about how this information is used, contact us using section 15 and we will respond in accordance with applicable law.

15. Exercising California privacy rights

To make a California privacy request, contact us using the email address in section 22.

Please:

  • say clearly that your request concerns California privacy rights;
  • tell us which right you are exercising;
  • include enough information for us to understand the request and to identify the account it relates to; and
  • tell us how you would like us to respond, if you have a preference.

SocialCue does not operate a separate automated privacy-request portal. Requests are handled through the contact address below. We will respond to verified requests within the time required by applicable law.

16. Verification of requests

We may need to verify your identity before completing certain requests. The information requested for verification will depend on the nature of the request and the information involved, and a request involving more sensitive information may require more to verify.

We use information provided for verification only to verify the request. If we cannot verify a request, we may be unable to complete it, and we will tell you why.

17. Authorized agents

California residents may use an authorized agent to make a request on their behalf where applicable law permits it.

Where an agent makes a request, we may ask for information reasonably necessary to confirm that the agent is authorized to act for you, and we may also ask you to verify your own identity directly with us.

18. Non-discrimination

SocialCue will not unlawfully discriminate against you for exercising privacy rights available to you. We will not deny you the service, give you a different level or quality of service, or charge you a different price because you made a privacy request.

Some features simply cannot work without certain information — for example, venue presence cannot work without location. That is a functional limit of the feature, not a penalty for exercising a right.

Declining to share a community, or removing it, never limits any feature, price, or entitlement: you remain in a venue’s All view whenever you would otherwise be visible. Declining to add Identity details, or removing them, likewise never limits any feature, price, or entitlement.

Notice of financial incentive. SocialCue offers one incentive program: referral rewards (Terms of Service, Section 14). When a friend joins with your referral code or invite link and completes their profile, and you both have a verified mobile number, you receive 50 Promo Credits. Each invited person can earn a reward once.

Taking part. You take part by sharing your referral code or invite link; the reward is added automatically, and there is no separate sign-up step. Taking part requires no personal information beyond what every member already provides. You can stop at any time by no longer sharing your code or link. Promo Credits you have already received stay in your Wallet as described in the Terms of Service.

What Promo Credits are worth. Promo Credits cannot be bought, have no cash value, and cannot be cashed out, exchanged, or transferred. They currently can’t be spent on any feature. We have not established a method for estimating a dollar value of Promo Credits or of the personal information involved, so this notice does not state one.

19. Minors

SocialCue is for adults 18 and over. The service is not directed to anyone under 18, and we do not knowingly collect personal information from anyone under 18. SocialCue does not sell or share the personal information of consumers under 16.

Our Age Restriction & Children’s Privacy policy explains this in full, including how to contact us if you believe someone under 18 has created an account.

20. Data retention

How long we keep personal information depends on what the information is and why we hold it. Relevant factors include:

  • the type of information and how sensitive it is;
  • the purposes we are using it for, and whether those continue;
  • whether we need it for security, fraud prevention, or trust and safety;
  • whether we need it to resolve a dispute or enforce our agreements; and
  • legal, tax, accounting, and other regulatory requirements that apply to it.

Different categories are therefore kept for different periods, and some records are kept after an account is deleted for the reasons described in section 11. Where we delete information automatically on a schedule, the period is fixed: stored location readings are deleted about 48 hours after they are taken, and records of your participation in a hotel public area about 24 hours after that participation ends. Records without such a schedule are kept for as long as they are needed for their purpose.

Wallet, credits, and membership information, and transaction and subscription information. We keep these while your account exists and, after it is deleted, only for as long as reasonably necessary for the purposes listed in section 11 — administering purchases and credits, refunds, reversals, chargebacks, and disputes, fraud prevention, accounting and tax records, and legal claims. When none of those purposes still applies, we delete them or remove the details that link them to you, and the interim period we have set for them is up to seven years after the transaction. Our other interim retention periods — up to five years for safety records kept after deletion and up to four years after deletion for signup compliance records — are set out in section 9 of our Privacy Policy. These are interim periods we have chosen, not statements of a legal requirement; deletion at the end of each period is not yet automated.

Retention, including technical logs, backups, and copies kept by our providers, is also described in our Privacy Policy.

21. Changes to this notice

We may update this notice as SocialCue changes or as our practices change. When we do, we will revise the “Last updated” date at the top of this page. If we make a change that materially affects how we handle personal information, we will provide any additional notice the law requires.
